Drivers granted appeals process for car clamping

Drivers are soon to be able to challenge car clamping firms in court after a landmark decision by ministers.
Alan Campbell, a Home Office minister, has tabled a piece of legislation that will allow motorists to make an independent appeal if they are clamped on private land or in a private car park.
Under the new law, a tribunal will be established that will have the power to make clamping firms pay back fines deemed to have been charged unfairly.
Compensation and other costs involved with the process for drivers can also be claimed through the courts as part of the legislation.
Clamping firms that refuse to pay compensation could risk losing their licences.
Alan Campbell stated, “the introduction of an independent appeals process will for the first time provide independent recourse for motorists who feel aggrieved by unfair practices of rogue clamping businesses.”
The move is likely to improve the reputation of clampers by giving drivers a feeling that they have regained control over the practice. It will also help to catch unlawful clampers who do not adhere to codes of conduct – thus improving the public perception of reputable clamping firms.
